1. The agreement

In short: These Terms form a contract between you and KinnyApps for use of our services.

These Terms of Service ("Terms") govern access to and use of websites, mobile applications, and related services (collectively, the "Services") provided by KinnyApps. Additional terms or product-specific policies may also apply and are incorporated by reference.

2. Eligibility & accounts

In short: Adults create and manage accounts for families. You must provide accurate information and meet any minimum age requirements in your region.

You must be able to form a binding contract in your jurisdiction to use the Services on your own behalf. Where the Services are used by or on behalf of a child, a parent or legal guardian is responsible for the account and for consenting on behalf of the family, as described in our Privacy Policy.

3. Acceptable use

In short: Use KinnyApps fairly and lawfully—no abuse, fraud, scraping, or attempts to harm the service or other users.

You agree not to: misuse, disrupt, or attempt to gain unauthorized access to the Services or related systems; use the Services for unlawful, harassing, or harmful purposes; reverse engineer or circumvent security or usage limits except as permitted by law; resell or redistribute the Services without authorization; or use automated means to access the Services in a way that impairs performance. We may suspend or terminate access for violations.

4. Account responsibility

In short: You're responsible for your credentials, your household's use of the account, and any activity that happens under it.

You are responsible for maintaining the confidentiality of login credentials and for all activity under your account. You must notify us promptly of any unauthorized use. For family accounts, the adult account holder is responsible for configuring controls appropriately and for minors' use of the Services under their supervision.

5. Intellectual property

In short: KinnyApps owns the product; you receive a limited license to use it—don't copy or misuse our brand or software.

The Services, including software, text, graphics, logos, and other content, are owned by KinnyApps or our licensors. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. You may not copy, modify, distribute, or create derivative works except as allowed by law or with our written permission.

6. Disclaimers

In short: We provide the Services "as is" and work hard to keep them reliable—but we can't promise perfection.

To the fullest extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.

7. Limitation of liability

In short: Our liability is limited to what the law allows—typically direct damages, capped where permitted, and not indirect losses.

To the maximum extent permitted by applicable law, KinnyApps and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from or related to your use of the Services. Our aggregate liability for claims arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us for the Services in the twelve (12) months before the claim or (b) one hundred U.S. dollars (USD $100), except where prohibited by law. Some jurisdictions do not allow certain limitations; in those cases, our liability will be limited to the fullest extent permitted.

8. Indemnity

You agree to defend and indemnify KinnyApps against claims arising from your misuse of the Services or violation of these Terms, to the extent permitted by law.

9. Changes & termination

We may modify these Terms or the Services. We will post updated Terms with a new effective date. Continued use after changes constitutes acceptance where permitted by law. You may stop using the Services at any time. We may suspend or terminate access for violations or operational reasons, with notice where required.

10. Governing law

These Terms are governed by the laws applicable in your primary jurisdiction of residence or as otherwise required by mandatory consumer protection rules, without regard to conflict-of-law principles. Courts in that jurisdiction may have exclusive venue, unless otherwise required by law.
